El objetivo de este artículo es identificar las consideraciones de quienes deben guiar la sanción o reforma de la ley penal. Este objetivo cobra relevancia si consideramos que las diferentes respuestas pueden impactar en las tasas de cumplimiento del derecho penal y en los niveles de coacción estatal arbitraria. Para ello, se analizarán algunas propuestas teóricas que se ubican en una cuyos extremos están ocupados, respectivamente, por el populismo y el elitismo penal. Estos argumentos son reconstruidos en el debate sobre (...) la reforma del Código Penal Argentino. En este debate, la disminución de la interferencia proveniente del delito y la disminución de la interferencia estatal arbitraria se presentan como objetivos incompatibles. En parte, ello se debe a que las propuestas teóricas que alimentan los argumentos del debate presentan algunas limitaciones para satisfacer ambas demandas. El republicanismo, a través de la defensa de una democracia deliberativa fuerte, tiene capacidad para satisfacer ambas demandas, aparentemente antagónicas. Sin embargo, esa capacidad se ve disminuida en sociedades desiguales. Por ello defenderé que una reforma guiada por aquella propuesta republicana tiene una capacidad que se limita a disminuir la interferencia estatal y mantener iguales los índices de delito. (shrink)

After introducing the adoption problem (AP) as the claim that certain basic logical principles cannot be adopted, I offer a characterization of this notion as a two-phase process consisting in (1) the acceptance of a basic logical principle, and (2) the development, in virtue of Phase 1, of a practice of inferring in accordance with that principle. The case of a subject who does not infer in accordance with universal instantiation is considered in detail. I argue that the AP has (...) deep and wide implications for the epistemology of logic, extending well beyond Kripke’s original target, viz. Putnam’s proposal for the empirical revision of logic and its background Quinean epistemology. In particular, the AP questions whether basic logical principles could have a fundamental role in our inferential practices, drawing our attention to the nature of basic inferences and the need to have a clearer conception of them before taking a stand on the matter of the epistemic justification of the logical principles. Este artículo se propone analizar la influencia de los estereotipos de género presentes en los servicios de salud sexual y reproductiva y del modelo imperante de atención al parto, en la generación de prácticas que pueden catalogarse como violencia obstétrica hacia las mujeres uruguayas. Luego de analizar ciertas prácticas en la salud materna y perinatal, entre ellas el valor que los profesionales de la salud atribuyen al consentimiento informado_, _se concluye que Uruguay se caracteriza por una atención al parto, donde (...) persiste un modelo biomédico, con tendencia al intervencionismo, que en conjución con los sesgos machistas presentes en las relaciones médicas, propician algunas evidentes prácticas que pueden encuadrarse como violencia obstétrica. ABSTRACT Data from digital technologies are increasingly integrated in public health research. In April of 2020, we interviewed a subset of participants who completed a survey approximately one month earlier. Using the survey, we contacted and interviewed participants who had expressed their willingness or unwillingness to share digital data for use in public health. We followed a directed content analysis approach for the analysis of the interview data. Among participants who had reported being unwilling to share data, concerns about privacy, (...) confidentiality, and the purpose of the research were cited. During the interviews, 76.9% of the participants who had who had previously indicated that they were unwilling to share their data, expressed willingness to share data in order to assist with COVID-19 prevention. Our results contribute to our understanding of people’s perspectives on sharing personal data and of the way their perspectives can vary as a function of potential uses of their personal information. En el último tiempo, han alcanzado especial popularidad en Argentina los tratamientos estéticos mínimamente invasivos, como las inyecciones de ácido hialurónico y toxina botulínica para rellenar y modelar diferentes partes del rostro. También aparece extendido, entre lxs médicxs y las clínicas estéticas, el uso de la plataforma Instagram para la promoción de estos servicios. Así, esta red social se convierte en un espacio donde lxs profesionales muestran, describen, explican y alientan este tipo de procedimientos. Nuestra investigación tiene por objetivo analizar (...) los sentidos que giran en torno a estos tratamientos, enfocándonos en la concepción del cuerpo que subyace en estas prácticas, los criterios estéticos que se ponen en juego, las formas de interpelación a las mujeres en tanto principales consumidoras de estos servicios y las transformaciones que prometen. A partir del análisis de cuatro cuentas de Instagram orientadas a la promoción de tratamientos estéticos en Mendoza y de cuatro entrevistas en profundidad a lxs médicxs responsables de estas cuentas, analizamos, en primer lugar, la concepción del cuerpo como un proyecto continuamente perfectible y las relaciones de tensión y complementariedad entre criterios estéticos clásicos y criterios contemporáneos; en segundo lugar, describimos la noción del alma como proyecto asintótico, con anclajes psíquicos y afectivos particulares y ciertas tensiones paradojales. Concluimos que los tratamientos estéticos se construyen como tecnologías de yo, convergentes con una est/ética propiciada por el ethos neoliberal. (shrink)

This paper presents the experimental results of a “Transcontinental Ultimatum Game” implemented between India and France. We use a standard ultimatum game, but in one treatment Indian subjects made offers to French subjects (ItoF treatment) and, in another treatment, French subjects made offers to Indian subjects (FtoI treatment). We observed that FtoI treatment bargaining mostly ended up with unequal splits of money in favor of French, while nearly equal splits were the most frequent outcome in ItoF treatment interactions. The experimental (...) results are organized through a standard social reference model, modified for taking into account the different marginal value of money for bargainers. In our model bargaining is driven by relative standings comparisons between players, occurring in terms of real earnings (that is monetary earnings corrected for a purchasing power factor) obtained in the game. The norm of equity behind the equalization of real earnings is called local equity norm, and contrasted to a global equity norm which would encompass the wealth of players beyond the game. According to what we observed, no beyond-game concern seems to be relevantly endorsed by subjects. (shrink)

In this work we argue that there is no strong demarcation between pure and applied mathematics. We show this first by stressing non-deductive components within pure mathematics, like axiomatization and theory-building in general. We also stress the “purer” components of applied mathematics, like the theory of the models that are concerned with practical purposes. We further show that some mathematical theories can be viewed through either a pure or applied lens. These different lenses are tied to different communities, which endorse (...) different evaluative standards for theories. We evaluate the distinction between pure and applied mathematics from a late Wittgensteinian perspective. We note that the classical exegesis of the later Wittgenstein’s philosophy of mathematics, due to Maddy, leads to a clear-cut but misguided demarcation. We then turn our attention to a more niche interpretation of Wittgenstein by Dawson, which captures aspects of the aforementioned distinction more accurately. Building on this newer, maverick interpretation of the later Wittgenstein’s philosophy of mathematics, and endorsing an extended notion of meaning as use which includes social, mundane uses, we elaborate a fuzzy, but more realistic, demarcation. This demarcation, relying on family resemblance, is based on how direct and intended technical applications are, the kind of evaluative standards featured, and the range of rhetorical purposes at stake. Los movimientos #MeToo y #YoSiTeCreo sin dudas son el motor de una transición que se dirige a rectificar los males que sufren las mujeres en términos de violencia sexual. Aunque el contenido de aquello cuya experiencia es compartida colectivamente o que es creído como una decisión colectiva de las mujeres que se sumaron a las consignas refiere a la violencia sexual, ambos movimientos ponen de relieve la existencia de un mal adicional consistente en un déficit de credibilidad que afecta a (...) las mujeres victimizadas. Este fenómeno conceptualizado como injusticia epistémica por la filósofa inglesa Miranda Fricker explica dos aspectos de estos movimientos que han impulsado una de las primeras grandes transiciones del siglo XXI3. En primer lugar, estos movimientos construyeron4 una audiencia antes ausente para receptar y acompañar los testimonios de víctimas de violencia sexual reconociéndolas como agentes capaces de transmitir conocimiento sobre sus propias experiencias. Al mismo tiempo impulsaron una crítica y demanda de reforma de las prácticas institucionales y sociales que se traducen en la ausencia de una audiencia adecuada y en la negación de la capacidad de las víctimas de conocer y testimoniar sus experiencias. En segundo lugar, estas campañas se tradujeron en actos de solidaridad epistémica que se dirigen a corregir o mitigar la injusticia testimonial que afecta a las mujeres en el ámbito de estos delitos. La aplicación del Código de Faltas ha dado lugar a una serie de consecuencias moral y penalmente reprochables. Las privaciones abusivas de la libertad son paradigmáticas porque nos remiten al problema de las múltiples manos. Para formular una versión tipo de un enunciado de responsabilidad retrospectivo condenatorio evaluaré los argumentos que han sido utilizados desde la teoría moral y la teoría penal como respuesta a aquel problema.

El Derecho y la Ética mantienen una relación estrecha, aunque no muchas veces se le brinda la atención que dicha vinculación merece. El análisis y la evaluación moral de las instituciones jurídicas y políticas conforman lo que se denomina "Jurisprudencia Normativa" o también "Ética Política". Una disciplina capaz de hacer avanzar el estudio de políticas públicas y herramientas jurídicas y sociales y, a la vez, juzgar su adecuación a criterios de corrección moral política. Este ha sido nuestro objetivo en la (...) compilación de los trabajos que componen este libro: ofrecer una investigación tanto de las instituciones como de las acciones de quienes participan en las prácticas que tienen lugar a partir de dichas instituciones. Los trabajos que se compilan aquí parten de un hecho difícilmente controvertible, esto es, que tanto los ciudadanos como los operadores jurídicos, en tanto participantes activos de una sociedad, pueden adoptar una actitud reflexiva frente a las instituciones jurídicas. De hecho, la concepción que se pretende impulsar a través de nuestras investigaciones afirma que existe un deber de desarrollar esta actitud. Al menos es un deber que corresponde a aquellos que están de una u otra manera vinculados con las profesiones jurídicas. Esta actitud de reflexión crítica se presenta en dos tipos de juicios de moralidad política: uno relacionado con las instituciones y otro con las acciones que se llevan a cabo dentro de aquéllas. ¿Seguimos reglas de inferencia al razonar? Por más intuitiva que resulte la respuesta positiva a esta pregunta, hay una serie de dificultades para vincular reglas lógicas y prácticas inferenciales. El Problema de la Adopción de Reglas de Inferencia constituye un desafío para todo aquel que proponga que podemos seguir nuevos patrones inferenciales a partir del reconocimiento de reglas. En esta sección temática se exploran diversos asuntos conectados a si podemos seguir un nuevo patrón inferencial en virtud de una regla.

Este artículo se ocupa del impacto que el uso de los sistemas predictivos automatizables tiene, y puede tener en un futuro inmediato, en la actividad decisional. Para abordar esta cuestión se han elegido tres aspectos que se consideran centrales: la inclusión de elementos evaluativos en los sistemas predictivos, el estatus normativo de los sistemas predictivos utilizados, y, en tercer lugar, la responsabilidad por la configuración formal y sustantiva del proceso decisional.

According to an influential view, when it comes to representing reality, some words are better suited for the job than others. This is elitism. There is reason to believe that the set of the best, or elite, words should not be redundant or arbitrary. However, we are often forced to choose between these two theoretical vices, especially in cases involving theories that seem to be mere notational variants. This is the riddle of redundancy: both redundancy and arbitrariness are vicious, but (...) there are cases in which one must be picked. Logical realists admit that there are some logical constants among the elite words. This leads to awkward questions, such as which among conjunction and disjunction is elite. In this paper, I show how the riddle of redundancy arises for logical realists, and offer a solution. This approach requires us to change how we represent negation. Instead of using some particular symbol, we represent negation by flipping formulae over the horizontal axis. (shrink)

Figurative communication (the use of metaphor, metonymy, hyperbole and irony) provides economy of expression, clarity, persuasiveness, politeness, evaluation, and communication of emotions. However, it also increases the potential for misunderstanding in situations when people lack shared background knowledge. This book combines theoretical frameworks with empirical studies that measure the effectiveness of different approaches to the use of figurative language in advertisements, to show how to maximise the benefits of creative metaphor and metonymy in global advertising. The influence of age and formal education on the development of moral reasoning in a Spanish sample of students was assessed by using a Spanish translation of Rest's Defining Issues Test. Our results support the hypothesis that moral development is highly related to both variables in our cultural context, although more so with formal education than with age.

This paper addresses some relations between the spatial politics of queer assemblies in spaces of protest and the constitution of collective political subjects. It does so by exploring the spatial politics of queer activism within the global Occupy movements, in the light of Judith Butler’s work on the performative power of assembly and the ambivalences of the Foucauldian concept of heterotopia. Specific challenges faced by queer activists in various encampments will be addressed in order to expose some tensions between the (...) constitutive exclusions inherent to the constitution of spaces of protest and the processes of coalition building needed to effectively overcome those very constitutive exclusions. This paper is about the represcussion that Túpac Amaru's rebellions had in the Government of the Tucumán. Here the intervention of the «bajo pueblo» took forms and very different ways to the Peruvians and altoperuvians, since they was incorporated in the «milicias» to the repression. The population of the Tucumán had a social composition diflerent to the Andean one, with a proportion a lot smaller than indigenous and with another organization leuel. The «milicianos» rebelled and disobeyed their leaders for own (...) causes. They was disorganized forms of protest in front of a cracked colonial system of authority and out. (shrink)

Abstract: The aim of this paper is to analyse and criticize the argument of the experimenters' regress proposed by Harry Collins in 1985. In order to do that, I begin with an introduction to the experiments that aimed to detect gravity waves performed by Joseph Weber during 1970, then I analyse and discuss both forms of the argument: the epistemological and the ontological. Finally, after giving an outline of a theory of experimental reproduction and an explication of the concept of (...) replication, I propose two ways of avoiding the experimenters' regress. (shrink)

The idea that experimentation is autonomous is widely shared amongst the New Experimentalists. However, it is not precisely stated how we should understand this thesis, or how to interpret it. In consequence, the aim of this paper is to explicate the different ways in which the autonomy of experiment thesis could be read, and to suggest, taking into account an analysis of the process by which an experimental result is constituted and exemplifying this process by the means of the study (...) of an experiment, the measurement of the speed of light, how this thesis could be clarified and how to establish its scope and limits. This article focuses on the epistemic transition to testimonial justice. It argues that the recognition of testimonial injustice in the context of reproductive rights may play a central role in this transition. First, I show how testimonial injustice undermines women’s legal protection against sexual violence and rights triggered by it such as the right to abortion. Second, I argue that the epistemic transition initiated by the #MeToo and #YoSiTeCreo movements call for transitional justice. In support, I review the circumstances of (...) transitional justice for cases like the transition to testimonial justice. Finally, I focus on the area of reproductive rights. I argue that policies of recognition contribute to epistemic transitional justice and complement other strategies aimed to overcome testimonial injustice such as the virtue of the responsible hearer and institutional compensatory virtues. In this paper I consider recent discussions within the representationalist theories of phenomenal consciousness, in particular, the discussions between first order representationalism (FOR) and higher order representationalism (HOR). I aim to show that either there is only a terminological dispute between them or, if the discussion is not simply terminological, then HOR is based on a misunderstanding of the phenomena that a theory of phenomenal consciousness should explain. First, I argue that we can defend first order representationalism from Carruthers' attacks (...) and ignore higher order thoughts in our account of phenomenal consciousness. Then I offer a diagnostic of Carruthers' misunderstanding. In the last section I consider further reasons to include mindreading abilities in an explanation of phenomenal consciousness. (shrink)

Nae Ionescu is one of the most influential and controversial Romanian thinkers. The present article explores a less used perspective in studying Nae Ionescu’s philosophical, political and journalistic activity: the philosophical roots of his major political ideas. The anti-democratic position of Nae Ionescu was, theoretically explained, by the criticism to Rene Descartes and J.J. Rousseau’s ideas. The individual is supposed to be an instrument of history and nation. Any individualizing tendency is allegedly a betrayal to the nation. Moreover, the leader (...) has mystical prerogatives therefore the universal suffrage is not consistent. On its turn, the nation is not defined on the basis of the social contract. Nation is “a community of love and life”, in Nae Ionescu’s opinion. Nae Ionescu’s beliefs largely influenced the right-wing Romanian ideology during the years between First and Second World Wars. LAS REPRESENTACIONES DE LAS MUJERES EN LAS CANCIONES DE CUARTETO DE CARLITOS “MONA” JIMÉNEZ: APROXIMACIONES.

Una vez que se desarrollen vacunas efectivas contra la enfermedad del coronavirus 2019 (COVID-19), estas serán escasas. Esto plantea la cuestión de cómo distribuirlas equitativamente entre países. La asignación de vacunas entre países plantea cuestiones complejas y controvertidas que involucran la opinión pública, la diplomacia, la economía, la salud pública y otras consideraciones. Sin embargo, muchos líderes nacionales, organizaciones internacionales y productores de vacunas reconocen que un factor central en esta toma de decisiones es la ética [1, 2]. No obstante, (...) se ha avanzado poco en la definición de lo que constituye una distribución internacional equitativa de vacunas. Muchos han respaldado la “distribución equitativa de la vacuna contra el COVID-19” sin describir un marco o sin ofrecer recomendaciones [3, 4]. Se han presentado dos propuestas sustantivas para la asignación internacional de una vacuna contra la COVID19, pero presentan graves fallas. Ofrecemos una propuesta más éticamente defendible y práctica para la distribución equitativa de la vacuna COVID19: el Modelo de la Prioridad Equitativa. El Modelo de la Prioridad Justa está orientado principalmente a tres grupos. Una es la alianza COVAX, encabezada por GAVI (por sus siglas en inglés), la Organización Mundial de la Salud (OMS) y la Coalición para Innovaciones en Preparación para Epidemias (CEPI por sus siglas en inglés), que tiene la intención de comprar vacunas para distribuirlas equitativamente entre países [5]. Un segundo grupo son los productores de vacunas. Afortunadamente, muchos productores se han comprometido públicamente con una distribución internacional de vacunas “amplia y equitativa” [2]. El último grupo son los gobiernos nacionales, algunos de los cuales también se han comprometido públicamente con una distribución equitativa [1]. Estos grupos necesitan un marco claro para reconciliar valores en competencia, uno que ellos y otros aceptarán legítimamente como ético y no solo como una afirmación de poder. El Modelo de la Prioridad Justa especifica lo que implica una distribución equitativa de vacunas, dando contenido a sus compromisos. Además, la aceptación de este marco ético común reducirá la duplicación y el desperdicio, lo que facilitará los esfuerzos por lograr una distribución equitativa. Eso, a su vez, promoverá la confianza de los productores en que las vacunas se asignarán de manera equitativa para beneficiar a las personas, lo que motivará un aumento en el suministro de vacunas para distribución internacional. A lo largo de la tradición psicopatológica, incluso de la pre-fenomenológica, se encuentra la categorización del delirio como creencia. Jaspers asumió ese uso y lo fundó fenomenológico-existencialmente, definiendo su carácter de convicción. El concepto de creencia ha tenido un largo recorrido dentro de la historia del pensamiento, aunque recientemente se ha intensificado el debate acerca de la visión doxástica del delirio. En virtud de lo ya mencionado, en el presente artículo presentamos un análisis conceptual de la creencia, con el objetivo (...) de identificar de manera precisa los aspectos esenciales que permiten al delirio definirse según ella. De esta manera, se discutirán algunas de las principales incursiones realizadas en el concepto desde la antigüedad periplatónica hasta José Ortega y Gasset, remarcando en cada pensador las directrices esenciales de su aproximación a la creencia. A su vez, introducir al filósofo español al debate psicopatológico permitirá incluir en la discusión dos aspectos importantes que creemos pueden ser fructíferos para la discusión filosófica sobre el delirio: la diferencia entre ideas y creencias, y la vitalidad de estas últimas. Finalmente, hacemos referencia al actual debate pro- y antidoxástico, haciendo hincapié en la necesidad de considerar la amplitud del concepto de creencia en su genealogía histórica. Con base en ello estaríamos en condición de acercarnos a la visión doxástica moderada que han defendido autoras como Lisa Bortolotti. (shrink)

Es probable que las vacunas contra COVID-19 sean escasas en los próximos años. Muchos países, desde la India hasta el Reino Unido, han adoptado el nacionalismo de las vacunas. ¿Cuáles son los límites éticos de este nacionalismo de vacunas? Ni el nacionalismo extremo ni el cosmopolitismo extremo son éticamente justificables. En cambio, proponemos el marco de prioridad justa para quienes residen en un país (PJR, por sus siglas en español), en el que los gobiernos pueden retener las dosis de la (...) vacuna COVID-19 para quienes residen en el país solo en la medida en que sean necesarias para mantener un nivel de mortalidad que no sea de crisis mientras están implementando intervenciones razonables de salud pública. En la práctica, un nivel de mortalidad sin crisis es el experimentado durante una mala temporada de gripe, el cual la sociedad considera un riesgo de fondo aceptable. Los gobiernos toman medidas para limitar la mortalidad por influenza, pero no existe una emergencia que incluya confinamientos severos. Este "estándar de riesgo de gripe" es una heurística no arbitraria y generalmente aceptada. La mortalidad por encima del estándar de riesgo de gripe justifica mayores intervenciones gubernamentales, incluida la retención de vacunas para quienes residen en un país por sobre la necesidad global. El nivel preciso de vacunación necesario para cumplir con el estándar de riesgo de influenza dependerá de factores empíricos relacionados con la pandemia. Esto vincula los principios éticos a los datos científicos que surgen de la emergencia. Por lo tanto, el marco PJR reconoce que los gobiernos deben priorizar la adquisición de vacunas para su país cuando sea necesario para reducir la mortalidad a niveles similares a los de la gripe sin crisis. Social ontology focuses on questions about the reality of human categories. The typical examples are gender and race. Common questions about them are: Do they exist? What is their nature? Do they exist in the best possible way? Meanwhile, the philosophy of psychiatry has been discussing the reality of psychopathology, what is the best way to classify mental disorders, and whether it is possible to define them without normative vocabulary. I think there is something not only strange but inadequate about (...) these discussions being held apart. Particularly, I hold that by being held separately these discussions are philosophically incomplete. In this paper, I argue that these debates are parallel in crucial aspects, but more importantly that they can benefit from each other if they start a dialogue. I suggest some paths we can take to start fruitful discussions and offer examples of the kind of outcomes we can expect. However, my main contribution is to sketch a common framework to map current discussions, make comparisons between them, and, more importantly, guide new research. (shrink)

Pérez Carballo adopts an epistemic utility theory picture of epistemic norms where epistemic utility functions measure the value of degrees of belief, and rationality consists in maximizing expected epistemic utility. Within this framework he seeks to show that we can make sense of the intuitive idea that some true beliefs—say true beliefs about botany—are more valuable than other true beliefs—say true beliefs about the precise number of plants in North Dakota. To do so, however, Pérez Carballo argues that we must (...) think of the value of epistemic states as consisting in more than simply accuracy.
